Welcome to RushRated! These Terms and Conditions ("Terms") govern your use of the RushRated application ("App") and any related services. By accessing or using RushRated, you agree to be bound by these Terms. If you do not agree, please do not use the App.

Please note: RushRated integrates with third-party services, including the Google Maps API, to provide certain location-based functionalities. By using these features, you are also bound by the Google Maps/Google Earth Additional Terms of Service and Google Privacy Policy. RushRated is an independent platform and is not affiliated with, endorsed by, or sponsored by Google.

2. User Accounts

• Registration: RushRated does not require a separate account. You can access the app by logging in with your Google account.

• Account Security: You are responsible for maintaining the confidentiality of your Google account credentials and any activity associated with your login.

• Termination: We reserve the right to suspend or terminate your account at any time, with or without notice, if we believe you have violated any terms.

3. Use of the App

• License: RushRated grants you a limited, non-exclusive, non-transferable, and revocable license to use the App in accordance with these Terms.

• Restrictions: You agree not to:

  • Use the App for any unlawful purpose.

  • Reverse-engineer, decompile, or disassemble the App.

  • Modify, adapt, or hack the App to falsely imply an association with Vivid.

  • Use any automated systems or software to extract data from the App.

  • Misuse or violate the terms of third-party services, including Google Maps APIs.

  • Sell, resell, or commercially exploit RushRated reports, results, or data without our prior written consent.

4. User Content

RushRated does not host or display any user-generated content. The only information stored is the email address used for login. Users are responsible for ensuring their use of the App complies with applicable laws.

5. Intellectual Property

• Ownership: RushRated and its licensors own all intellectual property rights in the App, including software, code, designs, and trademarks.

• Restrictions: You may not use RushRated’s intellectual property without prior written permission, except as necessary to use the App as permitted by these Terms.

6. Payments and Subscriptions

• Credits: Certain features of RushRated require credits. You can purchase credits as needed.

• Payments: All payments for credits must be made at the time of purchase.

• Usage: Credits are deducted when you use paid features of the App.

• Refunds & Support: If credits are deducted but you do not receive your report due to a technical error, you can contact us at contact@rushrated.com. After review, we will either restore the credits or issue a refund, as appropriate.

• Service Availability: RushRated operates on a best-effort basis. We cannot guarantee uninterrupted availability of the service. Daily scan limits apply, and at times you may encounter an “Overloaded” screen if capacity is reached.

• Delivery Time: While reports are usually generated promptly, delivery may take several hours depending on server load.

• Finality: All other purchases are final and non-refundable, except where required by law.

7. Privacy

Your use of RushRated is also governed by our Privacy Policy, which explains how we collect, use, and safeguard your information. By using RushRated, you consent to the practices described in the Privacy Policy.

8. Limitation of Liability

• No Warranties: RushRated is provided "as is" and "as available," without warranties of any kind. We do not guarantee uninterrupted service, error-free reports, or permanent availability.

• Third-Party Services: RushRated depends on data from third-party providers, including Google Maps APIs. We make no guarantees regarding the accuracy, availability, or completeness of third-party data.

• Limitation: To the maximum extent permitted by law, RushRated and its affiliates shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the App.

9. Indemnification

You agree to indemnify and hold harmless RushRated, its affiliates, and their officers, employees, and agents from any claims, damages, or liabilities arising from:

• Your use of the App.

• Your User Content.

• Your violation of these Terms or of third-party service terms (including Google’s).10. Changes to These Terms

We may update these Terms from time to time. If we make significant changes, we will notify you either through the App or by other means. Your continued use of the App after the changes take effect indicates your acceptance of the new Terms.
